Kevin Hart’s wife is suffering emotionally, but…she’s also in a pretty sweet position if she wants to leave his ass, explains one top L.A. lawyer.

A partner with top family law firm Walzer Melcher in California, says Eniko Parrish, who is also pregnant with the comedian’s baby, has a lot of leverage if she wants to leave him, which doesn’t seem like the case—but if she’s thinking about it…

Eniko, 33, was seen still wearing her wedding ring days after an alleged blackmail attempt on the comic sparked an FBI investigation, and Hart, 38, to issue a kind of admission and apology on social media.

“I’m at a place in my life where I feel like I have a target on my back,” Hart said. “And because of that I should make smart decisions. And recently, I didn’t. You know, I’m not perfect. I’m not going to sit up here and say that I am or claim to be in any way shape or form.”

He continued: “I made a bad error in judgment and I put myself in a bad environment where only bad things can happen and they did. And in doing that I know that I’m going to hurt the people closest to me, who’ve I talked to and apologized to, that would be my wife and my kids.”

The alleged blackmail attempt reportedly includes a “sexually provocative” video of Hart with another woman in a club and in a bedroom.

Uh oh.

FBI agents know the identity of the person who allegedly demanded money to not leak the video, reports TMZ.

While his wife insists there is no divorce talk, top Walzer Melcher celebrity divorce lawyer says although Eniko’s in a tough situation, because Hart is a public figure, his wife could make this very difficult if she so chooses.

The duo likely have a prenup which hammers out “strict financial issues” and not infidelity clauses, since CA. is a “no-fault” state—and although “infidelity is not a legal issue,” Eniko has major leverage and with Hart being a public figure, he obviously doesn’t want any dark secrets out that would tarnish his once impeccable reputation.

“When you ruin your image you ruin your future earning capacity,” says the celebrity divorce lawyer, adding that that would be bad for Eniko.

The top family law attorney also advises the less-earning spouse that it’s not good for anybody to ruin their partner’s earning capacity because it will affect them, too.

“His ability to work is what’s bringing in money,”  So even if Enniko’s mad, she should take him for what he’s worth in private if she wants.

Legally she has leverage, too. Although infidelity isn’t officially taken into consideration in court, a judge is likely to look at a very pregnant woman who was cheated on as more sensational, and as even more of a betrayal.

“The woman is really vulnerable and it’s an inopportune time. With a custody case, it weighs on the ability to co-parent. Judges are human and when they hear somebody was being unfaithful and the choice to file for divorce while pregnant was the only one, they will usually consider that. It shows the person wasn’t thinking while their partner was pregnant.”

Both circumstances—Hart being famous, along with a sympathetic judge—allow for an opportunity for Eniko to settle for a healthy amount of Hart’s income if she wanted to, and we’d likely never know how much.

“It can create an opportunity to sit down and settle. We have clients who are in the public eye or in good community standing and want to keep things out of the court system…I tell them consider cost of litigation, if you’re not paying 200,00 in legal fees that’s helpful. We always tell people if they are really ready to settle they’ll pay extra to avoid the circus.”
